1. Acceptance of terms

By accessing or using LevelMix ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We reserve the right to modify these terms at any time, and continued use of the Service constitutes acceptance of any modifications.

2. Description of service

LevelMix is a Software-as-a-Service (SaaS) platform that provides audio normalization services for content creators, including DJ mixes, podcasts, and video content. Our service allows you to normalize audio levels to specified LUFS (Loudness Units relative to Full Scale) targets.

We provide this service on an "as-is" basis and reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

3. User accounts

3.1 Account registration

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

3.2 Account eligibility

You must be at least 13 years old to create an account and use the Service. By creating an account, you represent that you meet this age requirement.

For users aged 13-15: You can create and use your account with your own consent. However, we encourage you to discuss your use of online services with a parent or guardian.

For users under 13: You may not create an account. If you are under 13 and wish to use LevelMix, please ask a parent or guardian to create an account on your behalf.

3.3 Account termination

You may terminate your account at any time through your account settings. We reserve the right to suspend or terminate accounts that violate these Terms of Service.

4. Intellectual property rights

4.1 Our intellectual property

All intellectual property rights in the Service, including but not limited to:

  • Software code and algorithms
  • Platform infrastructure and architecture
  • User interface and design elements
  • Trademarks, logos, and branding materials
  • Documentation and technical materials

are owned by LevelMix or our licensors and are protected by Swedish and international copyright laws. These Terms of Service do not grant you any rights to our intellectual property.

4.2 Your content

You retain all ownership rights to your audio files and content. By uploading content to our Service, you grant us a limited, non-exclusive, royalty-free license to:

  • Process your audio files to provide the normalization service
  • Temporarily store your files during and after processing
  • Generate processed versions of your files

This license terminates when your files are deleted from our servers (automatically after 30 days or when you manually delete them).

4.3 Copyright compliance

You represent and warrant that:

  • You own or have the necessary rights to upload and process your audio files
  • Your content does not infringe on any third-party intellectual property rights
  • You have obtained all necessary permissions and licenses for your content

We respect intellectual property rights and will respond to valid copyright infringement claims in accordance with applicable law.

5. Acceptable use policy

You agree not to:

  • Upload content that is illegal, harmful, threatening, or violates any laws
  • Upload content containing malware, viruses, or malicious code
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service or servers
  • Use the Service for any automated or bulk processing without authorization
  • Reverse engineer, decompile, or attempt to extract source code
  • Resell or redistribute the Service without written permission
  • Use the Service to infringe on others' intellectual property rights
  • Upload content that violates privacy rights of others

6. Service availability and data

6.1 Service uptime

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance and updates that temporarily affect availability.

6.2 Data retention

Our data retention policy:

  • Uploaded files: Automatically deleted after 30 days
  • Processed files: Automatically deleted after 30 days
  • Account data: Retained until you delete your account
  • Processing history: Retained for account management purposes

6.3 Backups

You are responsible for maintaining backup copies of your original audio files. We are not responsible for any loss of data.

7. Payment and subscription terms

7.1 Pricing

Pricing for our services is displayed on our website and may change with notice. You will be charged the rates in effect at the time of your purchase.

7.2 Subscriptions

If you purchase a subscription:

  • Subscriptions automatically renew unless cancelled
  • You will be charged at the beginning of each billing period
  • You can cancel at any time through your account settings
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial subscription periods

7.3 Payment processing

Payments are processed securely through Stripe. We do not store your complete payment information. You agree to provide accurate payment information and authorize us to charge your payment method.

7.4 Refunds

All sales are final. We do not offer refunds except as required by Swedish consumer protection law (Konsumentköplagen) or EU consumer rights directives.

8. Privacy and data protection

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms of Service by reference.

We comply with the General Data Protection Regulation (GDPR) and Swedish data protection laws. You have rights regarding your personal data as outlined in our Privacy Policy.

Special provisions for young users (Ages 13-15)

In accordance with Swedish data protection law, users aged 13-15 can provide their own consent for data processing. We take extra care to ensure our Privacy Policy and data practices are clear and understandable for all users, including young creators.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY SWEDISH LAW:

  • The Service is provided "as-is" without warranties of any kind
  • We do not guarantee that the Service will be error-free or uninterrupted
  • We are not liable for any indirect, incidental, special, or consequential damages
  • Our total liability shall not exceed the amount you paid us in the past 12 months
  • We are not responsible for loss of data, profits, or business opportunities

Nothing in these terms excludes liability that cannot be excluded under Swedish law, including liability for death or personal injury caused by our negligence.

10. Indemnification

You agree to indemnify and hold harmless LevelMix, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your content uploaded to the Service
  • Your violation of these Terms of Service
  • Your violation of any rights of another party

11. Dispute resolution

11.1 Governing law

These Terms of Service are governed by the laws of Sweden, without regard to conflict of law principles.

11.2 Jurisdiction

Any disputes arising from these Terms of Service shall be subject to the exclusive jurisdiction of the courts in Göteborg, Sweden.

11.3 EU consumer rights

If you are a consumer in the European Union, you may also have the right to bring proceedings in your country of residence, and nothing in these terms affects your statutory consumer rights.

12. Changes to terms

We reserve the right to modify these Terms of Service at any time. We will notify you of material changes by:

  • Sending an email to your registered email address
  • Posting a notice on our website
  • Displaying a notification when you log in to your account

Your continued use of the Service after such notification constitutes acceptance of the modified terms.

13. Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14. Entire agreement

These Terms of Service, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and LevelMix regarding the Service.
